The Bankruptcy Process Step-by-Step in Mississippi

Step 1: Initial Consultation with a Mississippi Bankruptcy Lawyer
 
The process starts with a consultation to evaluate your financial situation.  We do most of these over the phone to make it easier for our clients and in order to get things done quickly for our clients.
 
During this step, we will:

  • Determine whether Chapter 7 or Chapter 13 bankruptcy in Mississippi is right for you
  • Identify any risks or planning opportunities
  • Answer your questions and explain your options
 
This is where your strategy is built—and getting this step right is critical.
 
 
Step 2: Gather Financial Documents
Before filing, you’ll need to provide key financial information.
 
Common Documents Include:
  • Recent pay stubs or proof of income
  • Tax return for last year
  • Bank statements
  • List of debts and creditors
  • Information about your home, car, and other assets

Step 3: Complete Required Credit Counseling
Before filing, you must complete a credit counseling course from an approved provider.
  • Takes about 20-30 minutes
  • Can be done online or by phone
  • Required for all bankruptcy filings
 
Once completed, our office receives a certificate that must be filed with your case.
Step 4: Filing Your Bankruptcy Case
Once everything is prepared, we get you to review and sign it.  This can usually be done through e-signature to make things move a lot faster.  After you review/sign and pay the up front fees required, your case is officially filed with the bankruptcy court online.
What Happens Immediately:
  • The automatic stay goes into effect
  • Creditors must stop:
    • Collection calls
    • Lawsuits
    • Wage garnishments
    • Foreclosure and repossession actions

Step 5: The 341 Meeting of Creditors
 
About 3–5 weeks after filing, you’ll attend a required hearing called the 341 meeting.  This is all done by Zoom video.  You do not have to attend a hearing in person.
  • Conducted by a bankruptcy trustee (not a judge)
  • Usually lasts 5–10 minutes
  • Most creditors do not attend
 
You’ll answer simple questions about your finances and paperwork. We prepare you in advance so there are no surprises.
 
 
 
Step 6: Financial Management Course
 
After filing, you’ll complete a second course called debtor education.
  • Focuses on budgeting and financial planning
  • Required to receive your discharge
  • Typically completed online
 
 
 
Step 7: Your Bankruptcy Discharge
The discharge is the final step—and the goal of the entire process.
 
In Chapter 7:
  • Most debts are eliminated in about 3 to 4 months
 
In Chapter 13:
  • Debts are discharged after completing your 3–5 year repayment plan
 
Once your discharge is entered:
  • You are no longer legally required to pay discharged debts
  • Creditors are permanently prohibited from collecting
 
 
 
How Long Does Bankruptcy Take in Mississippi?
  • Chapter 7: Typically 3–4 months
  • Chapter 13: Typically 3–5 years
 
The timeline depends on your situation, but most cases move efficiently when handled properly.
